These Terms of Service (“Terms”) govern your use of CurrencyLink’s services, platform, website, and any related offerings (collectively, the “Service”). Please read them carefully. By using the Service or creating an account, you accept and agree to these Terms.

1. Parties & Scope

• These Terms are between you (“you,” “your,” “user”) and CurrencyLink Ltd (“we,” “us,” “our”).

• You may be using the Service as an individual or as a business.

• These Terms, together with our Privacy Policy, set the entire agreement between you and us.

2. Eligibility & Account Registration

• You must be at least 18 years old (or the legal age in your jurisdiction).

• You must provide truthful and accurate information during onboarding/KYC.

• You are responsible for maintaining the confidentiality of your credentials

• You must notify us if your credentials are compromised.

3. Services & Use

• We provide foreign exchange / currency conversion / remittance / payment services as described.

• You may initiate transactions, payments, or currency conversions in supported currencies.

• We will apply our rates, fees, and settlement timelines.

• You may not use the Service for any illegal or unauthorized purpose.

4. Fees & Charges

• All fees, margins, and charges will be disclosed before you confirm a transaction.

• You are responsible for paying any fees (banking, correspondent, intermediary) unless otherwise stated.

• Late payment / settlement failures may incur penalties, interest, or suspension.

5. Transaction Risk & Disclaimers

• Foreign exchange rates fluctuate; we are not liable for losses due to market movements once you submit an order.

• We do not guarantee that every requested currency pair or amount is available at all times.

• We reserve the right to refuse or cancel a transaction if risk, compliance or regulatory issues arise.

6. Compliance, KYC & AML

• You must comply with all applicable laws, including anti-money-laundering (AML), sanctions, and tax laws.

• We will perform identity verification, transaction monitoring, and risk checks.

• If we believe your use is suspicious, we may freeze funds, require additional documents, or suspend service.

7. Representations & Warranties
You represent and warrant that:

• You have power and authority to enter and perform under these Terms

• You will only use the Service for legitimate lawful purposes

• All information provided is accurate, complete, and up-to-date

• You are not on any sanctions, watch-lists, or restricted persons list

8. Intellectual Property

• All trademarks, service marks, logos, content, software, and design (“IP”) are owned by or licensed to us.

• You may not copy, modify, distribute, reverse engineer, or create derivatives of our IP (except permitted by us).

9. Acceptable Use & Prohibited Activities
You must not:

• Violate laws, infringe rights, or commit fraud

• Use the service to process illicit transactions

• Interfere with or damage systems or networks

• Use bots, automation, or scraping tools to interact with our API or platform unless expressly allowed

• Circumvent restrictions, reverse engineer, or attempt to breach security

10. Suspension, Termination & Refunds

• We may suspend or terminate your access immediately if you violate these Terms or laws.

• We may refuse or cancel operations at our discretion (e.g., due to risk).

• Refunds or reversals will follow our internal policy; not all services are refundable.

11. Disclaimers & Limitation of Liability

• The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied (merchantability, fitness for purpose, non-infringement).

• To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages.

• Our total aggregate liability under or related to these Terms will not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification
You agree to indemnify and hold harmless CurrencyLink, its affiliates, and their officers, directors, employees, and agents from any losses, damages, claims, liabilities, or expenses (including legal fees) arising from your breach, misuse, or violation of these Terms.

13. Dispute Resolution & Governing Law

17. Miscellaneous

• You may not assign or transfer your rights under these Terms without our prior written consent.

• We may subcontract or assign our rights / obligations as necessary.

• These Terms, along with any other policies (Privacy, Cookie, etc.), constitute the full agreement between us.
